    The man on my birth certificate is not my father legally and he knew this
    I was born in 1956, my mother was married and had an affair. The man she was married to know I was not his, but still put his name on the birth certificate. I did not know until I was 12 years old. My question is were do I stand legally with this. Am I intitle to anything from him, my old brother has told me that he is dividing up he's personal property, just leaving it to his 3 biological children, I'm not included in this. Was just wondering what the answer is. Thank you for your time.

    Who passed away, exactly? Your biological father or the man whose name is on your birth certificate?

    Was a will left when he passed away? You can try to fight it in court, but that doesn't mean you'll do so successfully.

    In most states if a child is born to a married couple both parents are considered the legal parents unless challenged. If your father signed the birth certificate, then fulfilled the role of father, then he is the legal father.

    However, a person can leave their estate anyway they want to with some limitations. If he doesn't want to leave you anything he doesn't have to. He may be required to leave a token amount just to not completely disinherit, but its his choice.
