    Failure to pay home Owners association fees
    I live in a town home association and have a question regarding a problem homeowner that has not paid heir home owner's association fee in over a year. Is there a recourse the association can take on this home owner besides fining (as they obviously do not care about paying the association). The home owners are loud and have regular domestic situations that require the police to break up. I do not feel safe with them in our neighborhood and do not feel it is fair that they live here and are not paying the fees that the rest of us are paying. Please advise.

    In my neighborhood, we arranged it so that we could put a lien of the homes of those who didn't pay. This way when they went to go and sell they couldn't until they paid, and the fine went higher and higher every week. We also banned them from neighborhood activities and restricted their access to neighborhood amenities.

    You need to read your HOA's bylaws. Most HOAs do have a provision for applying a lien against the property if dues or fines are left unpaid.

    The HOA may also include some provisions about illegal activities or breach of the peace.

    However, if its not in the by-laws then there is little you can do. You might amend the by-laws, by you can't make provisions retroactive.

    Why are you not taking this up with the Board of the HOA?
