Father's Rights-IL
Hello, I was wondering if any knows what are the fathers right in Illinois. My son is and was not married to this girl. He is a father that wants to be a huge part of the baby's life and the mother is making it very hard and the baby is not even born yet. Does my son have the right to request blood test and visitation even if they were not married? Will my son be able to get more than once a week and every other weekend visits.

Before the baby is born he really can't do anything about it. Once the baby is born he can do all that and request a DNA test, his visitation rights, child support order and so forth.
It would be best if he can be at the hospital when she delivers so they can do everything then and there because many girls sign the birth certificate father unknown to make it harder (or easier) on the guy.
Most visitations are weekends or every other weekend, alternating holidays and a week to a month vacation.
It depends on the Judge and the circumstances though.

Thank you so much for the information, do you know if we should get the paper work started for the blood test before the baby is born and do you know if that needs to be done via court order?

From what I understand you can't before the baby is born but I would check into exact procedures before hand at least.
I think at the hospital you shouldn't need a court order but if she is fighting it I am not sure.

In many states you can get a court order prior to the child being born. Speak to a local lawyer now to find out when/how to handle the details.

Yes, in most cases you can have most of it ready so as soon as the child is born, you can file for blood test before the baby leaves the hospital
But it has to all be done though court

Another thing you might suggest to your son is that now is the time he might consider a parenting class. BEFORE the baby is born and that can help sometimes with custody questions because it shows that he's trying hard. Also he can pick up pointers so when it is his turn he doesn't feel lost.
