Limitations and Collector's Obligation re Debt Collection
Yes, I moved to a foreign country back in 1997 and had a credit card balance. During 1997 I believe I paid the credit card completely off. I returned to Canada in 2004 and was contacted I believe in 2005 by a collection agency re this credit card saying that I owed them money. I told them I believed that I didn't owe anything and asked them to send proof of debt. All they sent me was a letter stating an amount due, plus interest. I visited a bankruptcy person and asked about it and he indicated that this company buys debts from other companies at a discounted amount and then try to collect and that I should ignore it and have not spoke with anybody from a collection agency since.

I have recently been getting calls from a collection agency, then a law firm. I have not acknowledged them but they are getting more aggressive now. I have received a letter similar from the one previously mentioned but have not received any registered letter or anything like that. ( I do not believe that it is the same collection agency) About three weeks ago, they left a message that if I do not contact them within a week, they would freeze my bank accounts and assets. The next week I got another message that if they did not hear from me within another week, they would again freeze my bank accounts and assets. I received another message today saying that if they do not hear from me by Monday they will freeze my bank accounts, assets, garnishment etc.

Can they do this without taking me to court ? Do they not have to send a registered letter or anything ?

Not sure what to do... you help would be greatly appreciated.
