    Probation violation
    My husband was picked up for a first degree theft charge while on probation. I'm trying to bond him out of jail currently so he can be here for the birth of his daughter, who is due any day right now. He got this first degree theft charge while being on probation. Now, he doesn't have a warrant for his arrest for his probation recovation- YET. I have spoken with this P.O. and she said that he doesn't have one now, but doesn't know if that will change later on down the road. Isn't she the deciding factor if he DOES get a charge, or not? She offered to "go to bat" for him and help in any way she could if he was to go home and remain there (which he did- he cooperated and did everything that she asked).

    I don't want to wait TOO long and see if the judge raises his bond so he can't get out. My husband advised me to wait and see if she will issue a warrant for his arrest before I even think about bonding him out, because I would then have to bond him out twice- once for the theft, the other for the revocation. Do I wait to bond him out and then they raise the bond, or do I bond him out and "bring him to her" so she can talk to him, only to find out she will put a warrant out for his arrest? He's prepared to go back to prison and face time, he just wants to be here for the birth of his daughter. I guess at this point I'm not really sure what I should be doing, any advice would be appreciated! Thanks a lot.

    If they charge him with a violation, there won't be a bond and he'll sit in jail waiting for a hearing...

    Of course it's the PO's decision (or her supervisor), but they're going to violate him.

    Do they care about the birth of your daughter?? Nahhh. They're not nice people.

    More than likely they will do the paperwork for the VOP and hold him in jail until the VOP hearing. In the meantime don't look for him to come home in a big hurry for the birth of your child. Frankly, the Court, PO and Judge really don't care as he should have been more "adult" about being on probation and not getting into more trouble. Don't bother bonding him out as he'll just be picked up again in a day or so. Can't imagine that he would not be violated.
