    What rights does a man who is not the father but signs birth certificate been on there for five years and has raised the child for five years have

    I would THINK he has the same rights as any biological father. Because when he signed the birth certificate he was saying that was his child. My friend who's daughter is 5years old and paying child support now thinks she may not be his. They won't even let him get a DNA test because he signed the certificate and has already started paying the support..

    It can depend on where he lives, but I would have him check into this further. If he signed it believing he was the father, and found out later he wasn't, changes can sometimes be made through the court system. He would need to have the DNA as proof however. He may need to recruit a more aggressive attorney.

    It depends on the State - what is his argument? Does he want to be the "legal" father or not?

    To get a DNA test ( if he can) will have to be done though the court, that is the only one that really matters anyway.

    In some areas after 5 years on the birth certificate he is the father. He will have to pay child support and can get visitation
    ** and should.

    If he wants to challenge it, it should do so though the court if allowed.

    In most states, signing the because is acknowledging paternity. The bio father could challenge it though there may be a short window of opportunity to do so.
