    When you are talking to another party do they have to inform you before they start recording the phone conversation?

    If you plan on using it for evidence and you don't have a wire tap warrant, yes.

    Yes they do. They don't have to inform you if they are the police tape recording you though.

    The laws vary from state to state in the US, in some, both parties have to know, in some states only one party has to know.

    Also it depends on what you want to use it for, in most cases, even if done illegally, it just can not be used in court

    It depends on the State - for example, you CAN record a phone conversation in NY if you are one of the parties. I could record a conversation between me and you. I could NOT record a conversation between my roommate and you.

    Again - it varies by State and in some States it's a felony.
