    VOP AND EVICTED with 2 children under 4
    Well my fiancé was arrested Friday for VOP (dirty urine) but it was his 1st test and he had only been on probation for a week and a half before he had to report to his po he knew there was no way that he was clean they came and took him in front of our 3 year old son and our 2 year old daughter mean while my landlord is in my face telling me that since in pregnant and can't work that me and my 2 children are going to have to get out by 10 that night.. . My 1st question is, is this legal and my second is how do I find out how long he could be in there?? Thanks in advance for anybody who has any kind of insight.

    Your landlord can not evict you without proper notice.

    Are you late with rent? What are your terms? Have you read your lease?

    What are the terms of your husband's probation? Why are you with a man who can't stay clean, even while the threat of jail is over his head? Are you clean? You could be risking losing your children in this environment.

    Your landlord must go through the formal eviction process which means proper notification and a court date and a hearing at which a Judge tells you to vacate within so many days.

    How long is the boyfriend going to be in jail? Hard to tell. But if they have him for a VOP he will probably have to stay in jail until his VOP hearing is held which could be weeks from now. You can go and see him in jail but he needs to put you on his visitor's list. Ask him to put you on his visitor's list the next time he calls you up.
