Do grandparents have the right to file for visitation? We live in Indiana and an attorney told my mother there is no such law in Indiana. Does anyone know for sure if this is true? How can I find this out? It says online there is grandparents visitation in Indiana... I am confused

They sure do, but the right is limited based on a few conditions such as the status of your relationship to the child's parent (are the parents married? Has paternity been established?)

Where does the child live and what is his/her parents status?

My name is on the birth certificate... we were never married... My son lives in the same state Indiana...

They are within their rights to try to get visitation. But based on your other question, their best route would be for you to get visitation.

My parents fought me for over two years for grandparents visitation. Here in the state of Indiana. My child had lived with me from birth and my child's father and I were never married, he is still alive, and he NEVER played a role in my child's life. Oh yeah and they called social services on me twice and they found absolutely NO CAUSE to file anything against me.

I had a restraining order against my parents and they still won visitation rights.

Hope you have lots of money to spend.

Its much easier to get visitation for grandparents if the custodial parent is not the biological link to the child. Meaning, if your ex were the primary custodian, it would have been significantly easier for your parents to get visitation.

Some states do not allow for grandparent visitation if their child is the custodian. IN does not seem to make this distinction.

You know I think your right. I think because it was my parents and not his parents is why they won. But either way I was just trying to point out that it IS possible for a grandparent to get visitation in Indiana.
