F1 CPT tax return questions.
Hi, tax expertises,
my question seems simple, but it troubled me a lot, thank you for your help.
I'm a F1, my wife is F2, and my kid's F2.
I have my SSN, they have no.
I interned and got paid last summer(2008).
now I'm trying to do the tax return.
federal is easy becasu I have the fee free CINTAX, all designed for F1 student.
but MO state tax return is troublesome.
all the free software e-filling asked for my wife and kid's SSN.
but they have no, so I have to input 777-77-7777.
and e filling was rejected because of this.
what can I do?

You are filing your federal return as the equivalent as Married Filing Separately. That is how you must file the Missouri return, so you will NOT be able to claim your wife or child.

Hi! Thank you so much, AtlantaTaxExpert.
Well, from your answer and my limited knowledge of tax,
If I didn't file federal return as married filing separately, say I filed as couples together,
I wouldn't have to file Missouri return?
Or anyway I need to file Missouri return, but I need to file in family together type?
That can use this software t file automatically?

I really need answer...

If you earned income in Missouri beyond a certain amount, you must, by law, file a Missouri state tax return whether you filed a federal return or not.
Further, you cannot ignore the rule that you file the same as you filed your federal return, specifically because you have NO SSN or ITIN for your wife or child.
Answer this question: what is your home country?
If it is India, Canada, Mexico or South Korea, you CAN claim your wife and child as dependents and therefore get ITINs for them; that would resolve your Missouri filing problem.

Thank you so much.
My home country is China, I'm F1 status, I have SSN, my wife and son(6 yrs old) are f2 visa holder, both have no SSN.
Actually, I tried each way to file federal tax return which followed by Missouri tax return, including separately or together with my family.
However, they all need to input my wife's SSN, otherwise I can't continue, except I file myself.
So finally, I just ignore all other ways, and file myself separately.
I know it's wrong because when it asks if I'm married, my answer can only be no.

I assume you mean by yourself, you filed as SINGLE, which is not correct.
You can file Married Filing Separately with just your wife's name and the letters "NRA" (for Non-Resident Alien) where the SSN would go, but that return must be mailed to the state of Missouri. It cannot be efiled.
I recommend you amend both the federal and the Missouri return to get the record straight.
