    Summary judgement
    Can anyone tell me what a summary judgement is and what I need to expect? I live in Texas and my spouse is going through difficulties due to past unpaid credit card bills.
    Can the creditors take his house? Social security benefits? He has no money in the bank, but I do.

    A summary judgement is issued without a full trial. I suspect the plaintiff has requested one because your spouse has not responded to collection efforts.

    As a resident of Texas his salary can't be garnished for these bills, nor can SS benenfits. They can't take the primary residence, However they can attach joint bank accounts.
