    F1 student in 1099
    I am a student in F1 visa. I came in USA in 2007 MAY. I got my SSN and start working from 2008 January. I am some list of questions.
    1.First I worked 3 months in my school under W2 where my fed income tax withheld was 16.47.
    2. Then in summer I worked in a compay under 1099 where I earned 6400.
    3.Then on fall I worked in another company where my FED income trax withheld was 423.91, Also my social security tax of 352.16 and medicare tax of 82.36 was withheld.

    Now, when I tried to file my income tax I see like I owe kind of 450 all together. I saw that for the job on summer I owe self employment tax of 960. I am really confused. Since, I am reading all those forums I find out that we don't need to pay self employemnt tax and I also find out that that we don't have to pay social security and medicare tax. Now, I don't know what to to to get refund of my SSN and medicare tax . Can I get help on this.

    Hopefilly, you did NOT pay the self-employment tax, because, as a student under a F-1 visa, you are NOT LIABLE for FICA (Social Security and Medicare) taxes or self-employment taxes.

    We can amend your 2008 return to get the self-employment taxes back, and then file Form 843 with Form 8316 to get the FICA (Social Security and Medicare) back.
