    Roommate & Girlfriend
    Hello,
    I have an apartment leased in my name only and a friend of mines is my roommate he has moved his girlfriend in without my permission I have asked him several times to tell her to leave but he will not he tells me that she does not bother me and besides she is the one who is paying his portion of the rent and without her he will not be able to pay his rent. Can I evict him or do I have to evict the both of them.

    Correction: if you are the tenant, you cannot evict anyone. You need to contact your landlord about this immediately, as they are the only one with any legal right to evict anyone from the premises.

    You said the apartment is only in your name, but I assume you told your landlord that your friend was moving in?

    I hate to disagree with my friend this, but the roommate is YOUR tenant, and you can evict him.

    I'd keep the girl too - especially a girl who PAYS.

    That's interesting. I've read in similar questions that a tenant has no right to evict anyone, only the landlord can do so...

    Hello again, this:

    The landlord of record can evict HIS tenant, and the roommate can evict HIS tenant.

    If they BOTH signed the lease then they'd BOTH be tenants of the landlord of record. THEN one tenant couldn't evict the other. But, that isn't what happened here.

    No tail... In the law, there are TWO sides to every issue, and sometimes more. I've argued the WRONG side here many times. It AIN'T nothing... Besides, you're cute.

    excon is right here, only a landlord can evict a tenant. But, since the OP is the only one on the lease, then any roommates he has are HIS tenants.
