    Security depost no refund
    I moved out of a House divded into two apartments. I have a dog and a cat.
    When we moved out we cleaned every thing and shampoed the carpets.
    The landlord said the carpet spelled like animal piss. To me it didn't. He also said the walls were yellow with from smoking in the apartment. He says he needs to put in a new rug, first he said it would cost $1000. For one room of carpet. I told him no way. Then he says he had it priced out at $660
    And he wants half of it $330 out of my $850 deposit. I told him no way the rug was old when we got into the apartment. He used this shiny thick paint on the walls, when it got humid they got sticky I am sure this accounts for the yellowing from the cigarett smoke. It took me 2 weeks after I moved out to get this information from him after continuosly calling him. It has now been almost a month. No Money offered, no detail listing of charges and no attempted contacting me to get this settled. Should I take him to court or what?

    Did your lease specifically prohibit pets and/or smoking? If not, then everything should be written off as ordinary wear and tear. Do you have any photographic evidence or an independent 3rd party willing to testify as to the conditions of the rugs and interior at the time you moved in? You'll probably have to go to small claims court to get your deposit back. From what you've said here it sounds like you have a pretty solid case.
