    Settlement with own insurance company
    I was hit head on by an uninsured driver in 2007. I am still undergoing treatment for my injuries. So far my private health insurance is paying my medical bills because my auto insurance will not pay any bills until I settle with them. It will be 2 years in August. Do I have to settle with my insurance company before then, and if I am still being treated will I have to get an attorney after August.

    Do you have 'uninsured motorist coverage'? Check this: "What is UM or UIM?

    Yes I do have uninsured motorist coverage. I had $5,000 med pay coverage which I have exhausted, so I was told by my insurance company in the beginning that when my med pay ran out my uninsured motorist coverage would kick in. I have $250,000 uninsured motorist coverage per person. But when med pay ran out they refused to pay any bills until I agree to a settlement and sign settlement papers. I only have six months until it has been two years. I see a surgeon this month, and then hopefully I will not need surgery and will be able to settle, but if I do need surgery I will not be able to settle before the two years are up. I do not have an attorney. I was hoping I would not have to get one. Is there a statue of limitations in this case. I live in Ohio, but the accident occurred in Pennsylvania. Suing the other driver is not an option. He lives with his parents, does not work, and is not a minor.

    By all means, you need to consult with a reputable attorney in your state, who is familiar with automobile claims. You may be able to contact the insurance commissioner of your state and get some information about what your insurer is trying to do. It appears that the statute of limitations in Ohio for personal injury is two years. Ohio Statute of Limitations
