    State and city tax under Optional practical tranining (F1)
    Hi,

    I am under my OPT and I took a job in NYS after graduating from Akron, OH in Aug 08. I received two W2 forms- one for the period I worked on F1 at Akron, Oh as a student (Jan - Jun 08) and the second for the period I worked under my OPT in New York State (Oct - Dec 08). I filed my federal returns (1040NR-EZ) based on both of my W2's and had no problems.

    Now, I am sure I become a part time resident for NYS while filing taxes as I wasn't there for the entire tax year. But, while filing OH state taxes, will I be considered as a full time or part time resident (From Jan - Sep 08, I was in Oh though I worked only till Jun 08) ?

    And, while filing city tax (Akron), Do I have to submit both the W2's and show my total income as the wages (including income earned in NYS) and file it as a resident or submit only one W2 corresponding to Akron and Oh and file as a part time resident and file the returns accordingly?

    Actually, you are a NON-resident of BOTH NY and OH due to your international student status.

    It probably will not affect your tax too much, but it makes the calculations easier, as you pay taxes only to the state where you earned the money.
