Good morning everybody,

I'm US Nonresident. I'm working at J-1 visa since October 2006 in USA. In October 2008, my visa changed at H1B visa.
I didn't pay taxes income (on my salary I think it's the basement) in 2008 for the 3 months I was H1B and in 2009 I didn't receive the W2 form, I just get the 1040 ES form. In 2009, I started to pay my taxe income (on my salary)
I would like to know how can I fill the 1040NR form? Is it the good one I need to fill? Even IRS could not answer to me.

What is your citizenship? What is J1 for: student, intern, teacher, professor, researcher..

Normally, everyone on J1 is exempt from residency. Then your days of J1 are not exempt.

J1 is a non Resident Alien : I was PostDoctoral Fellow (Exchange Student ) and we don't pay taxes.
The H1B visa is a Work visa but we pay taxes normally on this one. (and still non resident Alien)

Actually, a French student under a J-1 visa DOES have an income tax liability. They are exempt from FICA (Social Security and Medicare) taxes for five years (just like a F-1 visa holder).

For 2008, you would file Forms 1040NR-EZ and 8843 one last time.
