Hi,

I came to USA in Aug 2003 and have been filing 1040 NR for the past 5 (2003 - 2007) years. I know from many of the questions in the forum, that after 5 years I am considered as a resident and hence should be filing 1040.

My question is after 5 years, do I have look into the substantial presence test for residency or should I be filing 1040 regardless?

I have not filed form 8843 previously, is that a big deal?

For 2008 tax return, you will form 1040.

About the form 8843, should I send in forms 8843 for the past five years?
Or can I leave it alone?

If it were me, I would prepared the Form 8843 for 2003 through 2007 and mail them in. Better late than never.
