Need more information to answer your question if it concerns US immigration law. Are you in the US on a visitor visa or is your fiancé in Argentina? What's the situation?

I'm in argentina now... he is american I met him last year while I was working on a J1 visa.
My visa expired, I came back to my country... we want to be together... I'm going to visit him... and he told me to married him. I know that now we can't apply for a k1 visa. That why I'm asking if I can do it on a tourist visa.

Much better information. First of all... congratulations!

I don't see why you can't apply for the K-1 visa.

Since you are already engaged, you cannot lawfully enter the US ona B visitor visa with the intention to marry and file for permanent residence. You can enter with that visa if you come to visit him and plan on returning home.

You should file for the K-1 fiancée visa. He actually files it with the most important documentation being that you physically met in the last 2 years. You should include as much as possible to prove up a bona fide relationship, so cards, letters, photos, gifts, etc. are helpful.

Hope this helps, if it did, rate this answer. Thanks and good luck!

Thanks for your information.. but the problem that we can't apply for k1 visa is because I've been dated him for 5 months... I read about that, takes long time to get it that why I was thinking if it's a probl to do it on a tourist visa.. because I 'll visit him in a few month

The amount of time you've dated is not as important, as long as you've met in the past 2 years and are truly engaged. There is a long wait for the K-1 approval at the USCIS CSC at 6 months.

OK this leads me to ask, since this will be my first time in that country and we plan to file the petitions and get clearances needed, does this mean I will have to return because we have communicated by phone for many many months??
