    Violating Probation
    I live in Colorado and have a question pertaining to a deferred case I have in Arapahoe County and recently dismissed charges from Adams County, both controlled substance schedule II charges.
    Let me explain, I was put on probation in Arapahoe County in October 2006 with a deferred sentence of two years. This past June 2008, I was charged in Adams County on a controlled substance schedule II. Because this new charge happened while I was still on probation in Arapahoe County, (just a few months shy of my completion date in October 2008) I was in violation of my probation. However, during my court appearance in January 2009 in Adams County, ALL charges against me were dropped. What I need to know is if Arapahoe County can still pursue a probation violation against me? I have a court date in Arapahoe County on February 26, 2009 which is pertaining to this probation violation, but since Adams County dropped my charges, I really didn't violate my probation in Arapahoe County after all. Am I safe to assume that? Could that be considered inadmissable in court? Whatever legal advice, information or direction you can provide me with, I would be very appreciative.

    Hello D:

    You are required to report ALL contact with the police, even if that contact didn't result in charges being filed. Did you tell your Arapaho county PO about it?? No?? Pack your toothbrush.

    As noted, if you failed to report this violation, even if you are found not guilty the failre to report is another violation.

    If you did report this as soon as it happened, then most likely they will not find you in violation.

    I did inform my PO on the police contact, I was just wondering if if case is dismissed in one county, does another county have to follow suit? DJP
