    Small claims about verbal agreement
    My friend and I had a verbal agreement I had an extra phone plan already in use I was going to disconnect and she agreed verbaly to pay for a new contract for 2 yrs, she has paid on time every month till our recent fallen out.. She will not pay the bill that's owed for this month or the disconnect fee, I have text messages, and documents stating this is her line that she was going to pay it and then decided not to. She has stated in an email that she has no binding contract with me and that she will not pay me my money now... I have phone statements stating that when this other person had the phone she made calls in New Jersey only, the girl who took over the phone lives in philly and has only made calls in her area.. I have the drastic change when she took it over.. Plus I have the texts claiming it was hers but she isn't paying it and emails claiming the same thing. I am wondering do you think I have a case to take her to small claims to gett the 200 for last month which was january's bill, 200 for febuary's bill plus the disconnect fee of 200 as well. At first I only asked for the 200 just to cut the friendship off but she isn't even going to pay that now I'm going for it all.

    Yes, you have a case. Verbal agreements are binding, not to mention that you also have documentation from her stating that it is her phone line; that's a definite bonus.

    The judge will decide who s/he is going to believe because your friend will probably come to court and say you told her she never had to pay anything. Do you have any type of receipts showing that she had given you money in the past for the phone bill? Those would help make your case a lot stronger.
