    How to Access Damage in Rental
    I also wonder how to access for damages. For instance, in the kitchen, there is cosmetic damage to the faucet along with finger nail polish on the tile/grout/cabinets/counter there. There is also a burn mark on the master vanity from a flat iron on white countertop.

    You can see where they have literally "picked off" the black on the handle & finger nail polish is on that & the tile/grout behind. This is not a cheap faucet - Home Depot price is $719.10! GROHE Ladylux Plus Faucet, Stainless Steel and Black - 33759KD0 at The Home Depot

    I took a picture of the damage on the counter in the master bath, but it didn't turn out well. I need to take another one. Where there is other damage like blinds, I can easily just get a replacement cost for it when I make the purchase, but how do you access damage to items like this where they still function & I won't be replacing them at this time??

    You hire someone to fix it, and that's your damages. If "picking off" something is considered normal wear and tear, you don't charge for it.

    I don't think that is normal wear & tear. We lived there 5 years and the condition of the faucet was still in top shape (not a chip). They lived there less then 3 months. You don't get that in 3 months as normal wear & tear.

    And yes, I agree on the security deposit! Our mistake!

    If they still function and you still use them you have not been damaged. Cosmetic damage is worth nothing if it's not bad enough to repair.

    If you want to be paid for the items, replace or repair them and sue for that cost as well as diminished value, if there is any.

    Okay, I'll discuss it with my husband. I know it was purposeful damage due to a discussion we had with them on the night we argued. I'll discuss whether to take it as a loss or have it fixed and charge for damage!

    They didn't ruin a NEW one. They ruined a USED one. How much can you buy a USED faucet for, maybe at a garage sale? $20??

    Are you kidding me? You can't buy this faucet for $20 anywhere. The cost of the handle is probably cheaper then a used one - IF you can find one. Even on eBay, the cost of a new one is $400 and there are NO used ones. I think a $53 replacement handle is fair!
    And they did it intentionally! Seriously, in 3 months?

    I still have to figure out what to do with the damage to the vanity counter. I probably will have to price someone buffing the burn marks out of the countertop if they can do that.

    I stand corrected. I found ONE used (wrong color) on eBay & it's $130 starting bid: Grohe Ladylux Kitchen Faucet - eBay (item 330306723796 end time Feb-14-09 03:54:38 PST)

    So, most definitely, the replacement handle for $53 is VERY fair!

    It may be fair to you but you are entitled to the value of the faucet in the condition it was in when broken - and unless you have photographs you are going to get pennies on the dollar.

    It may not be fair but that's how the Court system works. I'm a landlord. I've had tenants walk out with appliances and I've received pennies on the dollar.

    Not in your situation (though I'm helping out my mother with her tenant eviction and have no doubt that we'll face the same thing when this guy is finally out). What I would do if I were you is to print out the EBAY ad that you've found and then follow it very carefully to see what it actually sells for at the end of all the bidding and print that off as well. I would think that having those papers as well as the ads that you've shared here (the $53) would show that you weren't just taking the most expensive route just to be a jerk.
