    F1 student - Will iget 100% Fed Tax back?
    HI,

    I am a student from India and currently on an F1 visa . I was interning in the summer of 2008 and received a salary of around 21000 for my services, In addition I have been working on campus and been receiving some pay. I have 2 separate W2 forms. One with Fed tax deducted over $ 4200 and the other with some $50. Will I get all this back when I file my tax return?

    Are F1 students also eligible to get the state and local taxes back? USA has a tax treaty with my country... ot sure if that helps.

    Any help in this regard would be highly appreciated.

    On F1/OPT you are exempt from residency for 5-years. You must file non-resident tax return Form 1040NR or 1040NR-EZ and Form 8843.

    Your income is not subject to FICA taxes but you must pay federal and state income taxes. On your OPT income you will get deduction based on tax treaty between the U.S. and your country.

    Since you are from India, as per tax treaty, you will claim standard deduction of $5,450 instead of itemized deduction. Read: Your U.S. Tax Return: U.S. Tax Filing Requirements for Non-Residents
