    Removing a tenant
    I am trying to get someone off my land. He had a five year lease that ended on Jan 1 2009. He isn't moving anything after I sent him a letter to move things off my property. I took a lease check for January but I didn't know the lease was up then. I got this land when my mom passed. I went the fisrt part of January and got a copy of the lease.from the court house. Then I sent him a certified letter to move. I gave him 30 days. I just wanted to know if he should still pay me while he is onw the property? His lease payment is due on the first and it is the seventh and I haven't seen anything.

    If you want him out, and he will not move, after you give him official notice, file for a formal eviction though the court.

    Yes, you are entitled to rent for the time he occupies the property. If he hasn't moved by the deadline you gave, you will need to go to court to obtain an eviction order.
