    Apt laws
    Hi,

    I have a lease that is expiring February 28th. I live in Houston, Texas. They told me that I have to give a 60 days notice, that is is stated on my lease. What happens if I leave at the end of my lease and do not give a notice?? Does it go against my credit? Am I still responsible for the 60 days that I am not there even though I do not have a lease? Help!? :

    Does your lease actually SAY that, or are you just taking some clerks word for it?

    If that's what it says, and you agreed to it, then if you don't give notice, you'll owe for two months rent... Or more **(see below).

    If they sue you, and they will, of course it'll go on your credit.

    Yes, you'll have to pay for two months that you're not there if you move on the 28th **... So, give them the 60 day notice that you agreed you would, and then you STAY there for the last 60 days.

    **However, if you give your notice NOW, it won't become effective until the 1st of March, and 60 days from then will take you through May.

    The problem here is that your lease may have an automatic renewal clause. If so, if you did not give 60 day notice that you were renewing, this clause may have kicked in and your lease's expiration date is now 2/28/2010.
