    2 month notice queston
    My landlord's lawyer just sent us a letter dated January 30,2009 that informed us that when our lease expire on February 28,2009. They were not going to renew and because the landlord was being nice we don't have to be out of the house until March 15, 2009. My question is aren't they supposed to give us 2 months notice to be out? Help?! Tom

    Hello Tom:

    It depends on your lease and your state law. It should state it pretty clearly in your lease. If NOT, then who knows when you're supposed to be out??

    We're only talking about 15 days here, so if you TAKE the 15 days, whether you're entitled to it or not, there won't be time for them to do anything about it. Afterward, if there's a dispute, you can let a judge decide. But, if you pay your rent, there's really NOTHING to decide.

    If you find the provision for 60 days, pay your rent as usual, note the clause in the lease that requires 60 days, and inform them that you'll be vacating on April 1. If you don't find the clause, pay your rent anyway, and tell them the same thing.
