    Ga. Realestate oral contract
    We moved into a home with the intention of buying. The landlord knew we wanted to buy, and still called us when he didn't sell the property. He gave us a rental contract and said that we could buy when we were ready. It has been over a year, and all our rent payments have been on time.     An offer which he accepted with a hand shake. We had papers drawn up and were waiting for my W2 when he came over with a hand typed letter asking us to move out. He said he had a family crises and his son needed a place to live, yet he offered us a different rental because we always paid on time. I read that an oral contract in realestate is unenforcable, but we had mortagage papers drawn up, can he still make us move? We would never have moved in without being able to buy. My husband is on disability and I work part-time, we can't afford a moving company and can't do it ourselves. We are very stressed over this and both of us are having nightmares. Help! What can we do?

    Welcome to AMHD. He can make you move if you do nothing, because you are a tenant. 'The law' requires that contracts for the sale of land be written, but there is an exception where the 'purchaser' is in possession; plus, you say you have the terms of sale 'drawn up'. You will need a competent lawyer to assist you in this.
