    The ex and taxes
    Every year me and my husband file our taxes to find out some else has filed his daughter we have the paperwork
    To get it all right, but no one will help us now we have to redo our taxes and take the child off and then file a amendment we have done this for 4 years now can someone help with the ex screwing us every year we have our taxes done by h&r block every year for this reason. We filed paperwork last year against her through IRS and sent the paper work thur mail.. and still nothing another year we have to wait to November before we will ever see anything we could lose or home and all we own because of this, can you help us we have a court order to file the child...

    Are you protesting someone else taking the exemption? What does the Court Order say? IRS has - and this has been posted at least 3 times in the last week - been deciding that the Court Order prevails. If the person who has primary custody claims the child, IRS - all other circumstances aside - will not rule against that Order.

    You husband needs to go back to the Court that issued the original Order and, if it does NOT allow him to take the exemption AND if he qualifies for the exemption, change the order.
