    Quiet title action
    I bought a mobile home park in 2005. Since we bought it cash the usual requirements for surveys etc. did not apply. We had an old survey which was lost so we proceeded to closing with no objections from our attorney . We bought the park and now 4 years later we applied for a loan on the park. Turns out, after getting the required updated survey, we are encroaching on the cities property! My new attorney advised we look into a "quiet title action" against the city since the park has been in existence with the mobile homes on the encroachment areas for about 40 years and they have never bothered us about that. They (city) refuse to give up the easment, so we are stuck. Can we file a quiet title action against a city?? Please help. Thanks And of course we will proceed with a claim against the attorney that represented us!

    I would see it as a adverse possession case. But if your attoreny is not up on it, perhaps time for a new attorney

    And time for a brand new survey to really be sure,
