    DNA tests
    I am pregnant now and will be having my child in April. I was with a guy and I got remarried he wants to have rights to see this child but he is worthless and doesn't do anything for the two children that he has already. I am putting my husbands name on the birth certificate. Can the courts make me have a DNA test done in Georgia or in Texas?

    I wouldn't recommend putting someone else's name on the birth certificate when you know that it's not their child; I don't even know if there are legal consequences for that or not. Even if you were to name someone else as the father, your ex has every right to contest the paternity and take you to court. If he is established as the legal father, then he'll be entitled to visitation and will have legal rights; he'll also have to pay child support.

    Why is he not supporting the 2 children he has now? Was there ever a support order put into place by the court? Why haven't the children's mother(s) asked for support?

    If he wants visitation he will need to go to court and request it. Yes, the court can order a DNA test be taken in ANY state.

    I would recommend not putting a name on a birth certificate that you know is incorrect. This is a legal document and there are legal ramifications to knowingly falsifying them. Your husband may also be required to sign an acknowledgment of paternity and if he lies on that he can be found guilty of perjury.

    The bottom line is this: sorry that you don't like the baby's father, but you slept with him, so you knew the consequences. You have no right to violate his rights just because of how he handles his other kids.

    Agreed, that's why I was asking about the other kids. Apparently, their mother(s) never got a court order for support which is the only reason I can see for him being able to get away with not taking care of them.
