    Can I keep my house when I am not on the title
    I bought a house in Katy Tx 5 yrs ago with a fiancé, I put the down payment down with my own money and had the two of us on the papers. We broke up within 4 months and he sued me for commonlaw. A jude awarded the house to me. I had to refiance to have his name taken off the title. I was unemployed at the time and could not refiance. A friend offered. My name is not on the title or deed. He has no financial interest in the house. I put the down payment, mortgage, taxes, everything. He now wants to seel my house and kick me out because we are no longer friends. Can he do this? I know I need a lawyer but can he even do anything?

    Welcome to AMHD. I am confused: you bought a house with a fiancé, broke up, had the home awarded to you, and had to refinance, yet your name is not on the title or deed? I don't see how that could have happened.

    Please go into as much detail as you can...

    It sounds as though you let a friend refinance your house because you couldn't. That means HIS name is on the deed, and YOU are not. Now, this ex friend, wants to throw you out of your own house.. Is that correct??

    If so, then you're going to need some WRITTEN contract between you and your friend saying what happened and who owns what... If you have NOTHING in WRITING, you're in trouble... Even if you DO, you STILL have troubles.

    The ONLY way you MIGHT save your home, is through a good real estate ATTORNEY. Go visit one TODAY!!

    When the judge awarded the house back to me I was unemployed and was unable to refiance without an income so this friend stepped up to help me out. I am working now with a good income and would be able to win it back if possible.

    You are correct and there is no paper stating anything, I am going to see an attorney this week but I want to investigate a little beforehand.

    I hope you are 'in possession of' (living in) the house; that you reside in the home may get you past the requirement of a written document or contract.
