    Is it a HIPAA violation?
    My employer owns a medical practise and I am the physician who works for her. She is supposed to bill for the patients so that money can come in. For the past several weeks, she has not been doing the billing either in the office or from home and therefore, there is no income. She has kept several patient records (charts) that need to be billed, in her house for over 2 months now. She is neither billing herself, nor is she letting me bill. I continue to see patients but without their charts. Is this not a HIPAA violation? If it is, who should I go to? Please advise.

    Have you talked to her directly about this?

    I would think that your compliance with privacy breaches and protocols could end you up in hot water.

    If I were a patient in your office, and was aware that my chart was in somebody's home, and not in a secure place where my privacy is protected, I would immediately file a report.

    There are a lot of things wrong with this situation, as you are aware. I don't know the procedure for filing a complaint, when you are the physician, but you need to figure that out and put a stop to this unethical behaviour.

    Well she is not giving out any personal info. Do your rules allow her to take personal files home ?

    After that you give her a warning to return the file the next day, if she does not, you fire her and demand the file back,
