    Landlord is taking me to rent and civil court
    My landlord took me to rent court for 2,200 dollars. The judge broke our lease and didn't award her any money:D. Now she is taking me to civil court for the 2,200 dollars. Can she sue me twice for the same thing in a different court?:confused:

    Probably not, but it depends on whether the judge in your rent court has the right to award money. For example, in NJ when a tenant doesn't pay rent the landlord has to file suit in tenancy court to get back possession of the property and then file suit in civil court to get the money.

    Contact the clerk of the rent court to find out if that court has the right to award a money judgment. If they do, then you have to file a motion to dismiss the landlord's suit in civil court based on the prior judgment. Attach a copy of the judgment to your motion.

    Even if he does have the right to sue you in civil court, if you bring in the ruling of the housing court, there is a good chance you will win in civil court.

    What did the rent court judge's ruling say? On what grounds is he suing in civil court. You may be able to countersue for court costs.
