    Trouble with Contract for deed in Mn
    In July 2008 we were out here visiting our son ( we had previously lived in Mn for 10 yrs) from Pa. While we were here the trailer home down from him became available. We understood the owners wanted to sell the trailer and the land with that trailer and the others. We arranged for a contact for deed on the trailer and when it was paid off we would then be able to buy the land for 5000.00. That was okay with us since our son wanted to eventually build a home on the remaining land. We returned to Pa. too pack up and come out. This was in Sept. and we made an advanced payment for October when the contact was written up. We moved in October and made our monthly Nov. payment. When we went to pay the December payment she refused it saying the contract was voided because we had not gotten insurance on the property. We were applying for it buy the ins. co. was taking it own sweet time but we did get it. She had also agreed to pay this years taxes with the 1st payment which we discovered she had only paid half. We are now waiting for the other shoe to drop. We do not want to move again. What we do want is for her to honor the contract. Both my husband and I are seniors and the move out was hard enough on us. What should we do now. We have put the monthly payment money in a savings account so that we can prove we have tried to pay plus kept all receipts. Any good advice is welcomed.

    You're going to need the services of a good real estate attorney. If you shop well, it shouldn't cost you TOO much.

    I agree with excon. You need to read the contract carefully. If the contract states that you needed to obtain insurance by a specific date, then if you didn't she could void the contract. On the other hand, I believe, that if you go to court the fact that you acted in good faith and can show you did apply for insurance plus the fact that she reneged on the agreement to pay the taxes would mean a judge would rule in your favor.
