    Custody
    Hi I'm 15 years old and for the past 4 years I've been wanting to live 100% of the time with my mom instead of 50/50. My dad is addicted to marijuana and alcohol and he is threatening me to go to military school or to move. Is there a way I can live with my mom?

    Yes, when with your mom you can have her petition the court for custody reassignment. At your age the judge usually issues a custody order in favor of the parent the child wants to live unless it is considered a dangerous environment.

    If this is the case for you, please ask your mom to ask her lawyer to go back to court to reassign custody.

    Hi, jmj,
    I do agree with your previous answer. You are old enough now that a Judge will listen to you, and hopefully allow you to live full time where you want.
    Your Mom will have to go to the local Court House, to the Court Clerk's Office, and ask them how to proceed.
    Having a lawyer help you and her with this is the best idea, though. A lawyer willl know what to do, and how to file papers, for custody changes.

    Also at 15, if your dad does not want you there, and your mom does want you, often the couple merely works it out and lets the child live where they want to and don't waste time and trouble going to court,

    So dad wants you to move, if you mom wants you, why not, the court order merely says what one party can force the other to do. But it does not mean they have to, if they work out informal agreements between thierself.
