    I have a lien on my future home
    I am about to purchase a home and discovered there was a lien on the home. The seller want me to pay for the lien which is about $1500 dollars. Their claims is because it's a foreclosed home. What do I do?

    Unless you and the seller have agreed otherwise, most contracts state that the seller will deliver the property with clean title, free of all liens. Therefore if there is a lien on the home then it is the seller's obligation to get the lien removed. This is normally done by the buyer deducting the amount of the lien from the purchase price and paying it off to the creditor as part of the closing. You shouldn't have to pay more than the original purchase price to get the lien removed. It should be deducted from the amount the seller is receiving from you.

    The above post is 100% correct. They could be trying to renegotiate with you because let's face it, if you will pay for it why wouldn't they get you to pay for it. Always, always, always follow the contract! If it is not stated in the contract that you are to pay for it, then it is from the proceeds of the seller. If the seller has no equity, then it is out of the pocket of the seller.

    The contract states everything that is pertinent to the deal. Most answers can be found by checking the paperwork. Sometimes the answers can be confusing so you might want some help from an attorney. There is a great chance that you can call the title company and they will give you the answer that you need at absolutley no cost as they are the ones putting everything on the HUD.
