I have a question. I have been accused of embezzelment of $1,000.00 to $20,000.00 by management. I went down and turned myself in and was let out on a PR bond. I have no record and live in Michigan. If I am convicted, what kind of sentencing should I expect? Our jail is way overcrowded, should I expect jail time, probabtion, or probably a bunch of fines? And if I am found not guilty can I press charges on my former employer for slander, loss of wages, and deflamtion of character? I am a mother of two with no father in the home, will they take that in to consideration seems they would be left alone with no one to care for them if I am sentenced to a long period of jail time?

Any embezzlement will have to be proved by the employer. Be sure you have an attorney. If you qualify for a public defender take it. If convicted you could be sentenced to 18 months in prison. If you are offered a plea it would probably be 6 months in jail and 3 years probation and a restitution fine and community service. This is just a good estimate. Any prior convictions will come into play during sentencing phase of your case should you be convicted.

The children at home don't really come into play in keeping you out of jail, sorry. If they have no one to take care of them they possibly would be placed in foster care. Try and find a trusted friend or relative to be lined up in case you do have to go to jail. There are a lot of moms serving time in jail/prison.

If your local jail is overcrowded you may be put on home arrest after serving some time in jail. Home arrest is not free though and costs so much per day and you must have a dedicated phone line. It is highly restrictive in that you can't leave your home once you are supposed to be home. Go to work only and then say shopping once a week between certain hours and then home period. If you are caught away from home due to the box calling in and saying you left your home, you can expect to be picked up by the police and taken to jail and considered an escape if you cut of the ankle bracelet for any reason. It is highly restrictive and very hard to do. You have to have prior permission from your PO to leave your premises unless it is a medical emergency that can be proven.
