    Divorce and community property
    My husband and I are getting divorced. My name is on the house and his. I have a another loan just in my name because his credit is bad this loan is on a truck he wanted. Problem is now his doesn't want to make the truck payment no more and wants to stick me with the junk and payment. He said he can get one now in his name. He called the bank up about the house and they said they might be able to take my name off the loan and have a underwriter do this and I would have to be in agreement with everything and sign the papers. I haven't got a lawyer yet for legal advice but feel I am getting the bad end of the deal here. Any advice would be helpful. Will be 3yrs I been married to a rotten apple. :confused:

    OK, on loans, no they will not hardly ever take your name off unless the other side does a refi,

    If he does not pay you will be held responsible.

    You need an attoreny and get court orders on all of this.

    I'm wondering what your question is. Is what a bad deal? Your name going off the loan on the house won't alter your ownership interest in the equity, if there is any. If there's none, you probably want to be off the loan. Is he dropping the truck and loan payment for it in your lap and buying another truck? If so he still will own one-half of any deficiency on the truck (the difference between what it's worth and what is owed). So again, what's the question?
