    KY tenant won't pay rent and won't move out
    My father owns rental property (eastern Kentucky, Boyd County) and has had many problems with tenants. There is this lady and her family who are at least three months behind on rent and refuse to move out. My dad (landlord) left her a note saying he would "like her out at the end of the month". (6 weeks ago) When confronted she claims that she's never been "served with and official notice" which she claims would still give her 30 day which she claims she could get extended to 90 (using her kids as leverage). Is it possible for someone to live in your house for FREE for half a year. Legally? (she admits receiving the note)
    My dad has taken people to court before but doesn't like paying court fees, he says the courts are never on the landlord's side. He tries to help the less fortunate and a lot of them take advantage of him.
    I will soon be taking over the property (as soon as she leaves) and need some good arguments. Can she use her kids to get out of being evicted and live there for free?
    We would like to avoid court.

    Well first sorry but father made some serious errors, he is not running this like a business and is being too nice.

    10 days after the first late or not paymnet he services her notice that she has to pay or quit.

    ** no 30 day notice on non payment.

    Then if she does not pay, he goes to the court house and files for a eviction though the court.

    The court is the only way to get her out, and is in the favor of the law. Sounds like Father is not documenting things, not using paid process servers to provide service

    But he is running a charity, and now it is winter, and the poor children, it is likely that liberal court judges allow them longer to move.

    Yea, I don't agree with how he does things. He's let people get away with SO much unpaid rent and damages. He want's to wash his hands of the whole thing and put me in charge. I plan on doing things differently.
    I'm not about making kids sleep out in the cold but she should think about that kind of stuff before not paying rent. And thinking she can get away with it. Using her kids to avoid paying rent. I don't think that is right. (sorry, venting now)
    She does work, her husband is on disability, I've seen people in worse situations live legitimately.
    Any idea how much the whole ordeal would cost?
