    Tax in the US for L1B visa
    Hello all,

    I am in USA on a L1 B VISA since November 2008 and plan to stay till May end 2009 ,

    During this period of my stay in the US I will not be getting US salary
    I will be getting only allowance (perdium)from India.

    Can you please advice me on the below questions


    1. If I stay in the US for 7 months at a stretch.
    That is 2 months in 2008 and 5 months in 2009,Do I have file tax ?

    2. Can a employee on L1B visa stay in the US without getting salary from the US employer and only allowance from India ?

    If your source of income is NOT from a U.S. company or a U.S. subsidiary of your Indian company, then you have NO REQUIREMENT to file a U.S. tax return for either 2008 or 2009 because you have not be in the U.S. for over 183 days in any one tax year.
