    You need to go to court to change the name and the father will, most likely, need to agree.

    You will need the fathers consent to change the last name... married or not.

    Do a simple name change through the court I had the same problem we just had a lawer draw up a name change and the judge signed off on it

    I suspect there was more to your situation. In most cases, changing the name of a minor requires approval of both parents.

    To SweetD,

    If the father is available and refuses to agree, then its likely not to happen. If the father is unavailable you may be able to get it done by showing a good faith effort to contact him.

    I am not too sure if this is accurate or not! I am in the same situation, My daughter is 2 and has her fathers name on bcertificate but is known by my name. I am dying to change her surname but her long lost father would never allow it

    This was an inappropriate use of the comments feature. The fact is that a birth certificate is a legal document. To change it requires a court order.
