Do I have to allow my husband to take my children for over night visits at his new girlfriends apartment? They live an hour away and I'm concerned with the condition of their living arraingement. The last time he had them, I found out that he allowed the children to sleep in the same bed as him and his new girlfriend. Also I checked on them there and found the apartment smelled of cat urine and feces because they have four cats and a full litterbox, so full that the cats were using the floor instead. Can I tell him when and where he can visit? He told me that if I do not give him permission to take them for visits that he will do it anyway. We live in Ohio and he abandoned us for her. I have started the paperwork for child support but he hasn't been served yet. I cannot afford a divorce or lawyer at this time.

You both have equal rights to the children at this point which means that yes you can tell him when and where he can see the kids and he can tell you exactly the same thing. Does he have a lawyer? If he does then you can't afford not to have one.

At this point, you both have the same legal custody, so when he has them, he does not have to give them back either.
At this point it is working together that will help I court.

Now once he gets court ordereed visits you will not have a say as to where he goes, you can take him back to court if he indangers the children

What is your best option since still married is to file a complaint for custody of your child/children. Since you are still legally married to their father you will need to go to your local court/goverment building and get the papers to fill out there are only 4 through domestic relation's. They review it right why you are there then you pay around $272.00 and they give you a court date and send your husband a notice in the mail bu certified mail the custody court date. I just filed one my court date is December 17th 2012 ! Good Luck !
