Last year my ex was arrested for admitting that he molested my 4 year old son. CPS took my children away from me because they thought I allowed him to do it because I wasn't the person who called the police. My ex's twin brother called because I told him what my son had told me. I didn't call myself because I was scared of what could happen. I didn't know if the police would believe me or not because we live in a small town and I wasn't on very good terms with the police dept. My children were placed in a foster home. CPS wouldn't even place them with my parents because they thought my parents had knowledge of it. Eventually, they listened to my parents and my children were placed with them after being away for 4 months. I wasn't allowed visitations at all though. Anyway, my attorney I had said that I had slim hopes of getting my two children back and that the judge would probably terminate my rights. He then told me if I had any hopes of being a part of my children's lives shouldvoluntarily terminate my rights so my parents could adopt them. He said that if I proceeded with trial then not only would I lose my rights but there was a possibility that my parents would lose rights to my children as well. Well, the day after my babies were taken from me, I found out I was pregnant with my 3rd child. Well, my attorney told me that I might have this baby taken from me as well and he told me I should voluntarily relinquish my rights and move out of state to have my new baby. Well, I ended up relinquishing my rights to my oldest two children. CPS came and investigated after my 3rd baby was born and they said nothing was wrong and that I was able to keep her. So my questions are 1. How come I am fit in their eyes to raise my 3rd child but not my oldest 2? And my main question is Can I restore my parental rights after voluntarily relinquishing them? Also, how can I go about getting an attorney that would do pro bono with this case if it's possible that I can get my babies back? Also, even though the case was dealt in the county I used to live in, can it be transferred to the county I live in now? Please someone help me. I am desperate. I just want my family back together the way it's supposed to be.

If the adoption went through then you have no legal grounds the children are legally now your sibblings. I can't tell you why you would be fit to raise this baby but not th other two apparently there were some problems with the first two. I don't see how you can get a lawyer to take on your case pro bono it just dosen't happen that way. You may be able to get a couple free consultations but that would be the extent of the free part. That being said did your parents actually adopt the kids or do your parents just have custody?

Like Stina said, if you're parents have legally adopted your kids then it's a done deal.

I think the only way to get them back would be to prove that you gave up your rights under duress, but that would be very difficult to prove. Also, the kids were taken away from you that also goes against you.

I don't see this ending the way you want, but I'm not a legal expert. Talk to a lawyer to find out your chances.
