    How long does a lawyer have too read faimlys will
    How long does a lawyer have too read the will my mom passed away two months ago and still haven't received a letter from him and does the will always have too go to probate if no one is going to contest it:confused:

    Whether a will goes to probate depends o generally on the nature of the estate. If its small the lawyers may not bother.

    Have you asked the attorney what the delay is?

    The time frame depends on the State - Lawyers don't "read Wills" (like you see on TV) in most places. The probate process begins and the heirs/beneficiaries are notified by mail, often with a copy of the Will, and requested to sign the forms indicating that they did receive a copy. Obviously, as I said, varies State to State.

    Who is the Attorney representing? Who is paying him to handle the estate? The fact that he may or may not have written the Will does not compel him to probate and/or handle the estate. Someone has to set the wheels in motion.

    And, yes, all Wills - and for that matter, most estates - have to be probated.
