Giving up joint custody temporarily.
My story follows. Married 17yrs have two beautiful daughters 16,12. Early 2007 my ex started having an affair with a female co worker. Kept in denial till finally I filed and divorced her March 2008 done. Mediation agreement we both have joint custody FRi to Fri.
No child support. She made 20,000 more than me in 07. I pay for daughters private school and health benefits,and all other expenses to take care of two kids. My question is my house is in foreclosure and I am not finanically fit to get my own place at the time. I will be moving in with a coworker (male) to try and save money so I can get my own place for my daughters. My ex is living comfortable,and her lover lives with her when the girls are with me. I never asked for child support for the girls when they are with me. At this time my daughters are better off with ex. I want to know is it possible to give her temporary full custody till I get situated I will still keep my responsibility as a father, and support them. She is very selfish and just thinking about her lover,and not my daughters. And do my daughters have a right to chose who to stay with she will be 17 in march and 13 in oct. Help if you can thanks. |

Children can not just decide where to live, ( at 17 they could in a couple states in the US) but the 13 can testify in court as to what she wants but the court still decides what is best for the child. So you are broke, you are still a parent, and if you have a place to live why would you not want your kids with you ? Sorry don't buy the story, what else is going on |

You don't ever want to give up any kind of custody - not ever. This will cause you more problems because on top of paying for their school, etc. you will then owe child support on top of all that - so - what are some other options? Have you gone everywhere you can go for help on the foreclosure? Is it too late to rent the home out or sell it? Do not give up the custody - you'll be paying child support to the ex which it doesn't sound like she needs it. Best of luck |
