I live in Ontario, Oregon. One year ago my son paid my house off and completely renovated it. He paid a neighborhood guy staying in a truck a daily wage to help with odd jobs. Plus fed him and his girlfriend everyday. Being a very compassionate person he was afraid they would freeze in that truck. As soon as he finished wiring he allowed them to use power for a light and heat at night as partial payment. This person told him he had a large settlement coming in a few months and he wanted to stay close to his mother who lives behind me. They talked about him purchasing a small back lot when he received check which he never did. No paperwork of any kind giving him permission and he has never paid a dollar. He was told he and girl friend ONLY could remain until August 2008 on condition that he keep all property clean and yard work done. Which he never did. As soon as my son left for Fla. The crap hit the fan,He moved a screened in trailer where truck was, people day and night partying, drug traffic, fighting etc. I being disabled and alone had no voice where they were concerned. He was told to leave, end of Aug. Drug Task Force raided while he was gone, they told his mother he couldn't stay anywhere in a camp situation for more than a week. Police were called by neighbors twice after that. Police told me he has tenant rights, I gave him 2 week duplicate eviction notice as City instructed. They ignored it completely. So my next step is? He can't be served because they hide. Why can't I have the camp trailer moved off my ground and on to the street 8 feet behind? Why are peoples rights like that more important than an elderly sick person? I have talked to police,The city and everyone seems to have a different course of action all leading nowhere. Thank You in advance, I'm sorry this is so long but such a bad and scarey situation I am in. :confused:

Hello F:

He CAN be served by registered mail, or by PUBLICATION. Then you evict him, and have the sheriff remove him. We have a copy of YOUR state landlord/tenant law at the top of the real estate page on a "sticky note". It'll tell you exactly what you have to do.

I agree with excon... you can still proceed with eviction. If they can't find him to serve in person, they will post the paperwork on the door.

If you've given them the proper notice to vacate the next step is to file for the actual eviction suit. Typically it's with the Justice of the Peace or Magistrate in the Precinct where the property is located. Call the clerk of court and ask if you personally have to file and appear, or if you can have an "agent" act on your behalf.

I know it feels painfully slow and horrible right now, but once you get the eviction started keep following through with each step of the process and it WILL work.

Does no one ever ask the simplest of Qns before these scenarios are even able to escalate!? If the guy's mother lives right behind your property.. Why did/does he not just move in with her if freezing is a likely consequence? Awesome for your son to have been so thoughtful nice.. but please society MAKE PEOPLE TAKE RESPONSIBILITY FOR THEIR OWN SITUATIONS! I hope your son has learned his lesson. Sure it sounds like these people suck.. literally siphoning from society.. but your son's at fault for the repercussions of his own unnecessary kindness.
