    Divorce after joint filing of I-751 application
    Hi,

    Me and my wife are married for more than 3 years.

    We have a child and own joint property. I got my conditonal green card two years back. It expired on July 5, 2008.

    We have filed the joint petition to remove the conditon in April 2008. I was given one year extension by uscis and my application to remove condition is still under process due to very heavy work load in Vermont service center.

    If we get divorced during this time while my I-751 is still under process, how is it going to affect my status? Will I get the unconditional green card. I have to take care of my daughter.

    When you get one year extension on your conditional green card, it means your relationship is somewhat vague in USCIS's view. It's best to put the divorce on hold until the condition's lifted.
