    Default on auto loan ?
    I am currently 2 months behind on my auto loan. We received a visit from a repo company
    That said it was his job to make us call Citibank and make arrangements or he would repo
    Our truck. We told him we were not 90 days behind yet and he said they had changed it to
    Repo on 60 days. He said they had people there to answer the phone 24 hours a day-
    We called and got voice mail on speaker phone so he could hear it. He said he would be
    Back the next day to repo unless we got the account current or made arrangements.
    We live in Tennessee. I have 2 questions- 1) Is this not harassment? I didn't think they could repo unless 90 days behind-2) are they not required to contact you in writing if they are going to repo ?

    It really upset me and I was not sure what my legal rights are- I have full
    Intentions of bringing the account up to date- we just got behind due to other
    Obligations..

    Legally it can be repoed as soon as the payment is overdue. I know of no law or rule that gives a number of days, such as 60 or 90. People have posted that the vehicle has been repoed 10 days after one payment is missed, 10 days being the grace period on the loan.

    No, it's not harassment - you owe the money, you haven't made the payment, they are trying to collect on the debt. The more time goes by, the harder it is for them to collect.

    No, they aren't required to notify anyone in writing that they intend to repo. If so, half of the people who got the call would hide the vehicle.

    So, yes, they have an absolutely right to repo the vehicle.

    If you believe you are being harassed, then notify them NOT to call you again. They will probably then simply come and take the vehicle, but you never know.
