It seems I keep asking questions on behalf of my girlfriend but she is really worried lately with her ex getting out of rehab in December. So here it goes.

What are the chances of the father getting full custody of the 2 little girls? The divorce decree already states they have joint custody but living with mother. He has been telling his girls that when he gets out, they are going to live with him. I'll give you a quick run down of his past

- He is currently in rehab for a heroin addiction.(This is not the first time)
- In April he was arrested for heroin possession, possession of a dangerous substance
- Also, in April he was arrested for a DUI, hit and run of 3 parked cars and reckless driving
- He does NOT have a job
- Has not paid child support in over a year
- Does not have a drivers license
- In over 2 grand of debt

While she has no record, steady job, and a driver's license.
I know they will try to attack my creditability but for the record... College grad, IT Manager at my job for the past year, no record at all

Put yourself in the judge's place. A Family Court judge is charged, first and foremost, with making decisions that will be in the best interests of the children.

Can you see a judge placing 2 young girls full time with a felon with an addiction and no job? While its impossible to predict what a judge will do, this defies any semblance of logic. The most this guy would be likely to get is supervised visitation.
