    Ny father died, left no will, had (4) stepchildren and (4) biological children. Do we as his biological children have any rights to his estate as he left a surviving spouse, the mother of his stepchildred. Please advise

    Yes you have a right to his estate, ( if there is any) if there is no will. Now the surviving spouse will have their rights also

    Yes you have rights however the spouce gets hers first generally. What state are you in? Do you have a lawyer? Will there even be an estate left after all his debts have been paid?
